EquipmentsFinder (the "Platform"), at www.equipmentsfinder.com and in the EquipmentsFinder mobile app, is operated by Earth Movers International Heavy Equipment Rental & Trading (L.L.C), a limited liability company licensed in Dubai under trade licence no. 602211, VAT TRN 100010460200003, of Capital Golden Tower, Office 706, Al Khaleej Al Tejari 2, Business Bay, Dubai, 231162, United Arab Emirates ("we", "us", "our").

These Terms are an agreement between us and you, the person or business using the Platform ("you"). By creating an account, posting a listing, making a payment or otherwise using the Platform you accept these Terms, our Privacy Policy, our Cookie Policy and our Refund & Cancellation Policy, which form part of them. If you do not accept them, please do not use the Platform.

The Platform is a marketplace where suppliers list heavy equipment for rent or sale, and contractors and buyers find it, post requests for equipment and contact suppliers. We also sell paid services to suppliers: listing plans, sale listing packages, access to requests on the inquiry board, lead unlocks and boosted placements.

We are not a party to any rental or sale between users. Unless we say otherwise in writing, we do not own, inspect, rent out or sell the equipment listed, and we do not guarantee its condition, availability, price, documents or legality, or that a user will complete a deal. Agreements for rental or sale are made directly between the users involved, who are responsible for them.

• You must be at least 18 and able to enter into binding contracts. If you use the Platform for a business, you confirm you are authorised to bind it.
• The details you give us must be true and kept up to date. We may verify them, including by calling the phone number you provide.
• Keep your password and sign-in codes private. You are responsible for what happens under your account; tell us straight away at support@equipmentsfinder.com if you think someone else has used it.
• One person or business may not open accounts to get around a suspension, a limit or a free trial.

If you post a listing or a request, you confirm that:

• you own the equipment or are authorised to rent or sell it, and it is actually available;
• the description, photos, specifications, location and price are accurate and not misleading, and you will update or close the listing when that changes;
• a business lists under its own business name;
• the equipment and the listing comply with the law of the country the equipment is in - the UAE or Saudi Arabia - including any registration, customs and safety requirements.

We may review, edit for format, decline, hide or remove any listing or request, and ask for proof of ownership or authority. We may do so without notice where we believe it breaks these Terms or the law.

Heavy equipment is dangerous if it is unfit, badly operated or wrongly documented. The people who rent, sell, hire or buy it are responsible for it, not us:

• Suppliers must hold the licences, registrations, inspection and test certificates and insurance their equipment needs, keep it safe to use, and provide only qualified and, where required, licensed operators.
• Hirers and buyers must check the equipment, its documents and the operator before use, and are responsible for their site, its permits and safe working.
• A "verified" badge means we checked a supplier's business details when it was given. It is not an inspection of the supplier's equipment and not a guarantee of their service.

You keep ownership of the text, photos and other material you post. You grant us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, resize, adapt and translate it, and to use it to operate and promote the Platform, for as long as it is on the Platform and for a reasonable time afterwards in backups and in promotion already published. You confirm you have the rights to grant this licence.

You must not post content that:

• is false, misleading, fraudulent or for equipment you cannot supply;
• infringes anyone's intellectual property, privacy or other rights;
• is offensive, abusive, defamatory, discriminatory or otherwise unlawful in the UAE;
• contains another person's personal data without their permission;
• is spam, a chain letter, or advertising for something other than the listed equipment or service.

You must not:

• use the Platform for anything unlawful or fraudulent;
• scrape, copy or harvest listings, contact details or other data by automated means, except search engines that follow our robots.txt;
• use contact details obtained on the Platform for anything other than the listing or request they came from - including unsolicited marketing - or pass them to others;
• harass, threaten or mislead other users;
• interfere with the Platform's security or operation, or introduce malicious code;
• copy, resell or build a competing service from the Platform or its content.

Misuse of computer systems and personal data can also be an offence under UAE law, including the federal law on combating rumours and cybercrimes, and we may report it to the authorities.

• The current paid services and their prices are shown on the pricing page, with the rules for each on the pricing FAQ.
• Prices are in UAE dirhams (AED) and include 5% VAT. We issue a tax invoice for every payment, showing the VAT separately.
• Payments are taken by card through our payment provider, Stripe. We do not see or store your card details. Your card issuer may apply its own fees, for example for foreign currency.
• A paid service is delivered when it is activated on your account: a plan or package when its allowance appears, a lead when its contact details are shown, a boost when it goes live.
• Paying for a plan, package, lead or boost does not guarantee any number of views, enquiries, leads or deals.
• We may change prices and plans. A new price applies to a subscription only from a renewal after we have told you about it, so that you can cancel first.

• Monthly plans renew automatically each month on the date you first subscribed, and your card is charged at each renewal until you cancel.
• You can cancel at any time from the Plans page in your dashboard. Your plan stays active until the end of the month already paid for and does not renew.
• Upgrades take effect immediately and the difference for the rest of the month is charged at once; downgrades take effect at the end of the month.
• If a renewal payment fails, we may pause the plan's benefits until it is paid; listings are hidden, not deleted.
• Sale listing packages, lead unlocks and boosts are one-off payments and do not renew.

• Requests on the inquiry board are posted by contractors and buyers. Unlocking a request shows you its contact details; it does not guarantee that the person will reply, hire or buy, or that the details in the request are accurate.
• New supplier accounts may receive a number of free leads, shown on the pricing page. Free leads are given once per business, have no cash value, cannot be transferred or exchanged for money, and are not refunded. We may withdraw them where an account was opened to obtain them again.

The Platform offers features that use artificial intelligence, such as AI search, the listing assistant and the photo scan that fills in a listing from its photos. Their results are suggestions and can be wrong. Check everything before you publish or rely on it: you remain responsible for your listings and requests. Submit only text and photos you have the right to share. How the data you submit is processed is explained in our Privacy Policy. We may limit or change these features at any time.

Refunds are governed by our Refund & Cancellation Policy. In summary: part-months of a cancelled plan are not refunded; unused sale packages can be refunded in full within 14 days; a lead unlock is final once the details are shown; and duplicate charges or services we cannot deliver are refunded in full.

We send you messages needed to run your account and your purchases, such as sign-in codes, receipts, invoices, renewal notices and replies to your requests. We send marketing only if you have agreed to receive it, and every marketing message has an unsubscribe link. How we use your personal data is explained in our Privacy Policy.

The Platform, its design, software, text, graphics, the EquipmentsFinder name and logo, and the selection and arrangement of its content belong to us or our licensors. You may view and print pages for your own use. You may link to individual listings. You may not copy, republish or commercially use the Platform or its content otherwise without our written permission.

If you believe content on the Platform infringes your rights, email legal@equipmentsfinder.com with the content's link, the right you hold, and your contact details. We will review it and remove the content where appropriate.

We may suspend or close an account, or remove content, if we reasonably believe it breaks these Terms or the law, puts other users at risk, or is fraudulent. Where we can, we will tell you why by email. Fees for a service removed because of such a breach are not refunded. You can close your account at any time from Delete your account; cancel any subscription first so that it does not renew.

• The Platform is provided "as is" and "as available". We work to keep it accurate, secure and running, but we do not promise it will be uninterrupted or error-free.
• Listings, requests and messages are provided by users. We are not responsible for them, for equipment, or for any deal, dispute, loss or damage between users.
• We are not liable for indirect or consequential loss, or for loss of profit, revenue, business, contracts, data or goodwill.
• Our total liability to you for any claim connected with the Platform is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
• Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

You agree to compensate us for claims, losses and reasonable costs, including legal fees, arising from your breach of these Terms, your content, or your dealings with other users.

We may update these Terms. We will show the date of the latest change at the top of this page and, for significant changes, tell registered users by email or on the Platform before they take effect. If you keep using the Platform after a change takes effect, the new Terms apply; if you do not accept them, stop using the Platform and cancel any subscription.

These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Please contact us first at support@equipmentsfinder.com so that we can try to resolve any complaint. Disputes that cannot be resolved that way are subject to the exclusive jurisdiction of the courts of Dubai.

If a part of these Terms is found unenforceable, the rest remains in force. If these Terms are translated, the English version prevails.

• Events beyond our control. We are not responsible for delay or failure caused by events we cannot reasonably control, such as outages of our providers, network failures, natural events or acts of authorities.
• Notices. We send notices to the email address on your account. You can send notices to us at legal@equipmentsfinder.com.
• Transfer. You may not transfer your account or these Terms without our consent. We may transfer them to a company that takes over the Platform.
• Whole agreement. These Terms and the policies they refer to are the whole agreement between us about the Platform. If we do not enforce a right straight away, we can still enforce it later.
